BASIC COURT IN MITROVICA, President of the Court Nikola Kabašić, pursuant to Article 14, Paragraphs 1 and 2, point 2.2 of the Law on Courts No. 06 / L-054 and Article 4 of the Regulation on Internal Organization of Courts, pursuant to the Decision of the Kosovo Judicial Council No. 53/2020 from 03/15/2020,
BASIC COURT IN MITROVICA, President of the Court Nikola Kabašić, pursuant to Article 14, Paragraphs 1 and 2, point 2.2 of the Law on Courts No. 06 / L-054 and Article 4 of the Regulation on Internal Organization of Courts, pursuant to the Decision of the Kosovo Judicial Council No. 53/2020 from 03/15/2020, taking measures after confirmed positive infected cases with coronavirus or Covid-19, held an urgent collegium with the Supervisory Judges, court administrators and judges of the Basic Court in Mitrovica on March 16, 2020, and made the the following:
D E C I S I O N
I All activities within the Mitrovica Basic Court, and its judicial branches in Vushtrri/Vučitrn, Skenderaj/Srbica, Zubin Potok and Leposavic, are reduced to a minimum, that is, to take only actions in court proceedings that are of urgent nature, including measures to secure the presence of the accused – detention or other measures, domestic violence cases, as well as other emergency cases that may possibly appear in criminal, civil, misdemeanor and juvenile court proceedings.
II All previously scheduled court hearings, or hearings for the month of March 2020, will be canceled, the dates for the appointment of new ones will be subsequently determined upon termination of the reason for which they were canceled, and summons will be served to parties on time.
The notice of cancellation of court hearings must be publicly displayed at all court facilities of the Basic Court in Mitrovica and in the regional courts in Vushtrri/Vučitrn, Skenderaj/Srbica, Zubin Potok and Leposavic.
III The Court Administrator, the deputy court administrator and the assistant administrators shall compile a weekly schedule assigning judges and court staff to serve as on call or be on duty, who will handle all emergency cases as referred to in paragraph I of this Decision on a weekly basis. A copy of the plan shall be submitted to the President of the Court.
IV Duty judges and court staff are required to be available 24/7 during the week they are on all.
V All judges and administrative staff not scheduled to be on duty can be engaged if there is a need for work and are required to be in their homes and apartments and available on the official telephone every business day between 8am and 4pm.
VI The measures set out in this Decision shall remain in force until a new decision of the President of the Court is rendered
VII Decision enters into force on March 16, 2020.
